Terms of Service

1. Acceptance of Terms

By accessing or using ConservX.ai (the "Platform"), operated by ConservX ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform.

2. Description of Service

ConservX.ai is a conservation intelligence platform providing analytical tools for protected area management across the world. The Platform integrates environmental data from multiple sources to deliver habitat analysis, species monitoring, and conservation planning tools.

The Platform is currently in Beta. Features may change, be added, or removed without prior notice. The service may contain software bugs or errors. We make no guarantees of uptime, data completeness, or uninterrupted service during the Beta period. By using the Platform during Beta, you acknowledge and accept these limitations.

3. User Accounts

To access certain features, you must create an account using email/password or Google OAuth. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must provide accurate information and promptly update it if it changes.

We reserve the right to suspend or terminate accounts that violate these Terms or remain inactive for an extended period. Upon account termination, your data will be handled in accordance with our Privacy Policy. We are not liable for any data loss resulting from account termination.

4. Data Sources and Attribution

The Platform integrates data from third-party sources including, but not limited to, GBIF, IUCN, WDPA, Google Earth Engine, and Dynamic World. These datasets are subject to their respective licenses and terms of use. We do not claim ownership of third-party data.

While we strive for accuracy, environmental data is inherently subject to uncertainty. The Platform's outputs should not be used as the sole basis for legal, regulatory, or safety-critical decisions.

5. Intellectual Property

All proprietary algorithms, analytical modules, user interface designs, and original content on the Platform are the exclusive property of ConservX. You may not copy, modify, distribute, reverse-engineer, decompile, or create derivative works from any part of the Platform without prior written consent.

You retain ownership of any data you upload and any reports or analytical outputs generated from your data using the Platform's tools. By uploading data, you grant us a limited license to process it solely for providing the Platform's services to you. You may not resell, sublicense, or commercially redistribute the Platform's analytical outputs as a competing service.

6. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of environmental protection laws
• Scrape, crawl, or systematically extract data from the Platform
• Interfere with the Platform's infrastructure or security mechanisms
• Misrepresent your identity or affiliation
• Resell, sublicense, or redistribute Platform outputs as a competing service without authorization

7. Force Majeure

ConservX shall not be held liable for any failure or delay in providing the service resulting from circumstances beyond our reasonable control, including but not limited to: natural disasters, wars, government actions, internet outages, failures of third-party cloud infrastructure (such as Google Cloud Platform), or disruptions to external data sources (such as GBIF, IUCN, or Google Earth Engine).

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONSERVX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Indemnification

You agree to indemnify and hold harmless ConservX from any claims, damages, or expenses arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

10. Governing Law

These Terms shall be governed by and construed in accordance with the applicable laws of the jurisdiction in which ConservX is registered. Any disputes shall be resolved through good-faith negotiation before pursuing formal legal proceedings.

11. Modifications to Terms

We may update these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform. Continued use after changes constitutes acceptance of the revised Terms.
